Operator: MULTISEEK (ABN 14 977 556 780), trading as Dreamcatcher Japan, Sydney, New South Wales, Australia (referred to as Dreamcatcher Japan, we, us or our)

This Privacy Policy explains how MULTISEEK, trading as Dreamcatcher Japan (Dreamcatcher Japan, we, us or our), manages personal information in connection with our website, travel referral and marketing services, enquiries, communications and related activities.

We aim to handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and other applicable Australian privacy laws. This policy should be read with any collection notice presented when information is collected and our Terms and Conditions.

The English version of this policy prevails to the extent permitted by law. A translation is provided for convenience only.

1. Scope and our role

Dreamcatcher Japan markets and refers users to travel products supplied, arranged and sold by independent third-party suppliers, booking platforms or merchants. Unless expressly stated otherwise, we are not the merchant of record, do not receive or hold the customer’s payment for a Travel Product, and do not collect payment-card details for those purchases. The merchant’s privacy policy applies to information it collects directly from you, including information entered after you leave our Website or use an embedded booking tool.

2. Personal information we collect

Depending on how you interact with us, we may collect:

  • identity and contact details, such as your name, email address, telephone number, country and postal address;
  • enquiry and referral details, such as destinations, travel dates, group size, preferences, messages and relevant booking references;
  • account details, if accounts are offered, such as a username and account preferences;
  • communications and complaint records, including emails, contact-form submissions and notes of telephone conversations;
  • marketing preferences, including subscriptions, consent records and unsubscribe requests;
  • technical and usage information, such as IP address, browser and device type, approximate location, pages viewed, referring pages, link interactions, cookie identifiers and timestamps; and
  • content you voluntarily submit, such as reviews, photographs or other feedback.

We do not intentionally request payment-card details, passport numbers or government identification through our general contact channels. Do not send these details to us by email, contact form or social media.

3. Sensitive information

We do not ordinarily seek sensitive information. You may nevertheless choose to provide information about health, disability, accessibility, dietary or religious requirements in connection with a travel enquiry. Where the Privacy Act requires consent, we will collect and use sensitive information only with your consent or as otherwise permitted or required by law. Please provide only information reasonably necessary for the enquiry.

4. How we collect personal information

We may collect personal information:

  • directly from you through contact forms, email, telephone, surveys, subscriptions, accounts, competitions or other Website tools;
  • when you use or interact with our Website, links, widgets, advertisements, emails or social-media pages;
  • from a person making an enquiry or booking on your behalf;
  • from suppliers, booking platforms, merchants and service providers when needed to respond to an enquiry, assist with a referral or resolve an issue; and
  • from publicly available sources where lawful and reasonably necessary for our activities.

Where lawful and practicable, you may interact with us anonymously or using a pseudonym. We may need your identity and contact details where they are required to respond, facilitate a referral, verify authority, handle a complaint or meet a legal obligation.

5. Why we collect use and disclose information

We may collect, hold, use and disclose personal information to:

  • operate, secure, maintain and improve the Website and our referral services;
  • respond to enquiries and communicate with you;
  • connect you with a supplier, merchant or booking platform at your request and provide reasonable referral assistance;
  • administer accounts, promotions, surveys, reviews and other Website features;
  • personalise content, measure Website performance and understand how users interact with our services;
  • send marketing communications where permitted, manage preferences and process unsubscribe requests;
  • detect and prevent fraud, misuse, security incidents and unlawful activity;
  • manage records, disputes, complaints, legal claims and business administration; and
  • comply with legal and regulatory obligations and enforce our Terms and Conditions.

If you do not provide requested information, we may be unable to respond to your enquiry, provide a requested feature or facilitate contact with a supplier.

6. Who we may disclose information to

We may disclose personal information where reasonably necessary to:

  • travel suppliers, merchants, booking platforms and their service providers where you ask us to facilitate an enquiry or referral;
  • website hosting, cloud storage, analytics, customer-support, communications, email, security and information-technology providers;
  • advertising and affiliate partners, subject to applicable law and your available choices;
  • professional advisers, insurers, auditors and contractors who assist our business;
  • regulators, law-enforcement agencies, courts or other persons where required or authorised by law; and
  • a purchaser, successor or adviser in connection with a proposed or completed business sale, merger or restructure, subject to appropriate confidentiality and legal requirements.

We do not sell or rent personal information. We may use or disclose aggregated or de-identified information where it is no longer reasonably capable of identifying an individual.

7. Overseas disclosures

Because the Website promotes travel products in Japan and may serve users globally, personal information may be disclosed to travel suppliers, merchants or booking platforms in Japan and in the country relevant to your enquiry. Our technology, analytics, communications and cloud providers may also process or store information outside Australia, including in the United States and other countries in which those providers or their subprocessors operate. These locations may change over time.

Where APP 8 applies, we take reasonable steps required by law before disclosing personal information to an overseas recipient. Overseas privacy protections may differ from those in Australia.

8. Cookies analytics and similar technologies

We and our service providers may use cookies, pixels, tags, software development kits, web beacons and similar technologies to operate the Website, remember preferences, protect security, measure audiences and performance, understand referrals and support advertising. These technologies may collect identifiers and technical or usage information.

You can manage cookies through any consent tool we provide and through your browser settings. Blocking or deleting cookies may affect Website functions. Browser controls do not necessarily control all similar technologies.

9. Analytics and advertising services

We may use services such as Google Analytics and Google advertising products. Those providers may use cookies or similar technologies and may combine information about your activity with information from other websites and services, in accordance with their own privacy policies. Available controls may include Google’s advertising settings, consent controls and browser tools. Our policy does not govern a third party’s independent handling of personal information.

10. Direct marketing

We may send offers, news or other direct marketing where you have consented or where otherwise permitted by law. You can opt out at any time by using the unsubscribe facility in the message or contacting us. We will action valid electronic unsubscribe requests within the period required by law. Opting out of marketing does not prevent necessary service communications about an enquiry, account or complaint.

11. Third party websites and embedded tools

The Website contains links, advertisements and embedded tools operated by third parties. A third party may collect information directly from you when you interact with its content or leave our Website. Its privacy policy and terms apply to that collection and to any purchase. Review them before providing personal or payment information.

12. Security

We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures may include access controls, authentication, secure service providers, system monitoring and staff or contractor confidentiality requirements. No Internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

If we suspect an eligible data breach, we will assess and respond in accordance with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

13. Retention and deletion

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, to resolve disputes and meet legal, accounting and recordkeeping obligations. Retention periods vary according to the information and context. When information is no longer required, we take reasonable steps to destroy or de-identify it, unless retention is required or authorised by law.

14. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details below. We may need to verify your identity or authority before responding. We will respond within a reasonable period and, where applicable, explain any lawful refusal and available complaint options. We do not charge for a correction request. Any access charge permitted by law will be reasonable.

15. Privacy complaints

To make a privacy complaint, email us with your name, contact details, the conduct complained of and the outcome you seek. We will acknowledge the complaint within 2 business days where reasonably practicable, investigate it fairly and aim to provide a substantive response within 30 days. We will tell you if more time is reasonably required.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner. The OAIC generally expects you to complain to us first and allow a reasonable time for us to respond.

16. Children

The Website is intended for users aged 18 years and over. We do not knowingly seek personal information directly from children. An adult arranging travel for a child must have authority to provide the child’s information and should provide only information reasonably required by the relevant supplier or merchant.

17. Automated decisions

As at the effective date, we do not arrange for a computer program to use personal information to make decisions solely by automated means that could reasonably be expected to significantly affect an individual’s rights or interests. If this changes, we will update this policy and provide the information required by applicable law.

18. Changes to this policy

We may update this policy to reflect changes to our practices, services or legal obligations. The current version and effective date will be published on the Website. Changes apply from the stated effective date and do not reduce rights that cannot lawfully be excluded.
